MITA Consulting – Terms & Conditions
1. Introduction
These terms and conditions apply to all courses, training or audits provided by MITA Consulting Ltd (“the Provider”). By booking and attending a course, participants agree to abide by these terms.
2. Booking and Payment
A PO Number is required at the time of booking to confirm a place.
Reports or unit standards may be withheld if payment has not been received.
Payment Terms: Invoices must be paid on the 20 th of the month following, unless otherwise agreed in writing. Late payments may incur interest and administration fees.
3. Cancellation, Substitution & Refund Policy
More than 15 working days before course: full refund (minus admin fees).
15 working days or less before course: 100% of course fee charged.
The General Manager may review cancellations on a case-by-case basis.
Substitutions: Employers may substitute another participant at no additional cost by prior agreement with The Provider.
Transfers: Requests to transfer to another course date will be considered but are not guaranteed.
The Provider may cancel/reschedule courses due to unforeseen circumstances. Participants will be offered the option to transfer.
4. Course Participation
Participants must arrive on time; late arrivals may not be admitted.
Participants are responsible for personal arrangements (e.g. meals, transport, medical needs).
The Provider is not liable for lost or damaged belongings.
5. Conduct, Health & Safety and Liability
Participants must behave professionally and respectfully.
MITA reserves the right to remove any participant who is disruptive, unsafe, or poses a risk to others.
All participants, employers, and MITA staff must comply with the Health &Safety at Work Act 2015. MITA may suspend training if unsafe conditions or behaviour are identified.
MITA is not liable for personal injury, loss, or damage incurred during training except where required by law.
MITA is not responsible for indirect or consequential costs (e.g. travel, accommodation, lost wages) if a course is cancelled, rescheduled, or a participant is removed.
6. Certification & Competency
Completion of a course does not guarantee competency or licensing. Learners must meet any additional industry or regulatory requirements (NZQA, EWRB, etc.) before they are deemed fully qualified.
7. Intellectual Property
All course materials belong to MITA Consulting and cannot be copied, distributed, or used commercially without permission.
Personal notetaking is allowed, but recording or reproducing content requires prior consent.
8. Privacy & Data Protection
MITA may access your NZQA Record of Achievement and share results with your employer.
Information may be shared with NZQA, Connexis, and EWRB for reporting and education purposes, in line with the Privacy Act 2020.
By enrolling, participants consent to the collection and processing of their personal data under MITA’s privacy policy.
9. Pastoral Care
MITA Responsibilities
Provide academic, pastoral, and H&S support in safe, compliant training venues.
Ensure equal and equitable access to training in line with the Human Rights Act 1993.
Employer Responsibilities
Provide a safe workplace, proper induction, and supervision.
Support apprentices to attend off-job training, arranging travel/accommodation where required.
Student Responsibilities
Attend all sessions on time and follow the Student Code of Conduct (respect others, follow H&S, report incidents, no drugs/alcohol, no harassment or bullying).
10. Complaints Process
1. Raise concerns with the trainer (or Senior Management if uncomfortable).
2. If unresolved, submit a written complaint. Acknowledged within 3 working days.
3. MITA will review and respond within 10 working days.
4. If still unsatisfied, complaints may be escalated to NZQA or relevant external agencies.

11. Force Majeure
MITA is not liable for any failure or delay in delivering training due to events beyond its reasonable control, including natural disasters, pandemics, industrial action, government restrictions, or other unforeseen circumstances.
12. Amendments
MITA reserves the right to update these terms at any time. Changes will be communicated via our website.
